On May 13, 2020, the Verkhovna Rada of Ukraine voted for the Bill 2571-d, also known as "anti-Kolomoisky". It seemed that it would become a stabilizing factor for the Ukrainian economy, as well as a significant obstacle to the illegal enrichment of the oligarchs.
First of all, according to the document, the former owners of PrivatBank, Igor Kolomoisky and Gennady Bogolyubov, will not be able to regain a financial institution, as well as receive significant compensation from the state.
This law was a key requirement of the IMF to provide financial assistance to Ukraine.
The events of recent weeks and months, however, indicate that it is too early to celebrate. Everything is much worse than it seemed.
Oligarch Ihor Kolomoisky and his partners, using their influence in the courts and various branches of government, have won several dangerous victories over PrivatBank and the NBU. The unstable Ukrainian economy has found itself in even greater difficulty.
According to “Finbalance”, on May 26, 2020, the Central Commercial Court of Appeal upheld the appeal of Privatoffice LLC and lifted the seizure of more than 400 properties owned by oligarch Kolomoisky and his partners. Also, according to this source, on June 2, the Supreme Court closed the proceedings in case №910/13013/19 at the request of JSC Nikopol Ferroalloys Plant. The plant is owned by Kolomoisky and a court made a decision to recover UAH 22 million from PrivatBank.
On Wednesday, June 10, the Court of Appeal considered the cancellation of the precautionary measure in the case of the Surkis brothers against PrivatBank, amounting to $ 257 million. The Surkis brothers are partners of Igor Kolomoisky and co-owners of the 1 + 1 TV channel.
The appeal was filed by the Cabinet of Ministers, namely the Ministry of Justice of Ukraine. As a result, PrivatBank's lawyers were unable to participate in the hearing and influence the process, and the decision was made in favor of the Surkis brothers.
Anton Shvets, one of the co-founders of the “Democratic Axe”, informed that immediately after the court ruling in favor of Surkis brothers, all members of Privatbank's supervisory board received summonses to the prosecutor's office as part of a case of refusal to pay $ 257 million.
The summonses were written on June 5, in advance, in court and before receiving a tranche from the IMF, and were given only on June 10 and 11.
The criminal case against the management of PrivatBank was initiated by the Minister of Justice Denis Malyuska, because the case and the statements were handed over to the prosecutor's office by his direct subordinate.
The IMF tranche was originally scheduled for June 5, but was postponed, first to June 9 and then to June 11. When the IMF funds were transferred to Ukraine,
representatives of the Ministry of Justice and the Prosecutor's Office began to act.
The very next day after receiving the tranche from the IMF, on June 12, 2020, the Constitutional Court of Ukraine received a submission from 64 people's deputies at once. They demand that the "banking law" be checked for constitutionality.
On June 17, the Finance Committee of the Verkhovna Rada, in which the majority of deputies are connected to Igor Kolomoisky, assessed the work of the National Bank of Ukraine unsatisfactorily and filed a lawsuit for the resignation of the bank's chairman. We remind you that the work of the NBU was highly appreciated by Ukraine's international partners.
The logic and sequence of such decisions and actions indicate that this is a planned and synchronized special operation of several groups of persons holding the highest government positions and under the influence of Igor Kolomoisky and his partners.
Of course, even Kolomoisky's influence and control are limited. For example, an unexpected bright spot was the decision of the Supreme Court in favor of PrivatBank, in the case against the Surkis brothers for a billion UAH.
But, nevertheless, it becomes clear that Igor Kolomoisky and his partners are not threatened by Ukrainian justice at all. The web of his influence has penetrated too deeply into Ukrainian state institutions, and therefore one can only hope for international law. We remind you that Igor Kolomoisky is under investigation by the US Federal Grand Jury. He is suspected of laundering hundreds of millions of dollars from real estate in the United States, especially in Ohio, according to BuzzFeed News.
