Kostiantyn Pilkov

Judge of the Commercial Cassation Court within the Supreme Court 

Pilkov Kostiantyn was born on December 8, 1983 in Kyiv.

In 2004, he graduated with a bachelor's degree from Kyiv National University of Trade and Economics. In 2005, he received a master's degree in law from the same university.

July 2003 – October 2003 – specialist, State Company "Ukrekokomresursy" of the Cabinet of Ministers of Ukraine, Kyiv. 

October 2003 – June 2004 — Head of the Department of Claim and Contract Work of the State Enterprise of the Ministry of Industrial Policy of Ukraine, Kyiv region.

June 2004 – February 2006 — senior associate at the European Alliance law firm, Kyiv. 

February 2006 – July 2010 – a lawyer, senior associate, associate partner of the Lavrynovych & Partners law firm, Kyiv.

 August 2010 – October 2017 – managing partner in the field of international trade and arbitration, customs and tax law at the Cai & Lenard law firm, Kyiv.

From September 2016 until present — Associate Professor at the Department of International Private, Commercial and Civil Law of Kyiv National University of Trade and Economics, Kyiv.

On February 18, 2016, Pilkov Kostiantyn defended his dissertation on "Evidence in International Commercial Arbitration". And received the degree in the specialty 12.00.03 — civil law and civil procedure; family law; international private law.

Since November 2017, Pilkov Kostiantyn works as a judge of the Commercial Cassation Court within the Supreme Court 

Pilkov Kostiantyn is the author of more than 50 scientific and practical publications, including the monograph «Theory and Practice of Proof in International Commercial Arbitration» and the scientific-practical manual «Evidence in International Arbitration: Criteria for Admission and Evaluation.«

The judge's declaration does not include family members or real estate. Judge Pilkov declared a Honda Civic 4D (2007).

1) On May 8, 2019, the Supreme Court with the panel of judges of the Commercial Cassation Court: Selivanenko V.P. (chairman), Bulgakova I.V. and Pilkova K.M., with the participation of Assistant Judge Lazareva O.S. (on behalf of the presiding judge), case № 910/9971/17 was considered. The decision on the case decided not to satisfy the complaint of the Antimonopoly Committee of Ukraine against the decision of the courts on the fine of oil companies of Ihor Kolomoisky "Ukrtatnafta" and "NPK Halychyna". The total amount of conspiracy at oil auctions is estimated at a total of 1.3 billion hryvnias (Korrespondent.net).


2) On August 19, 2019, in the case № 916/1058/18 the Supreme Court with the panel of judges of the Commercial Cassation Court: Selivanenko V.P. (chairman), Bulgakova I.V. and Pilkova K.M. The materials of the cassation appeal of Hadzhybei LLC  and the statement of the NBU on the abuse of Hadzhybei LLC procedural rights to the decision of the South-West Commercial Court of Appeal from 28.02.2019 on the claim of the NBU of Ukraine toHadzhybei LLC for foreclosure on the mortgage, which does not declare independent claims on the subject matter of the dispute, on the side of the defendant — the public joint-stock company Commercial Bank "Privatbank".

The court decided to refuse to open cassation proceedings on the cassation appeal of Hadzhybei LLC against the decision of the South-West Commercial Court of Appeal in the case № 916/1058/18 (28.02.2019).

The NBU's application for recognition of actions as an abuse of procedural rights, leaving the cassation appeal without consideration and imposing a fine should be rejected (Liga.net).
