Volodymyr Selivanenko

Judge of the Commercial Cassation Court within the Supreme Court

Volodymyr Selivanenko was born on September 15, 1958 in Ivankiv, Kyiv region.

In 1981, he graduated as a lawyer from the Taras Shevchenko National University of Kyiv.

From 1981 to 1993, he worked as a legal adviser, senior legal adviser, as well as head of the legal department of various enterprises.

In 1993, he worked as a prosecutor of the Kyiv Regional Prosecutor's Office.


From November 1993 to March 2003, Volodymyr Selivanenko worked as Deputy Head of the Department of Generalization of the Practice of Application of Legislation, and then Head (Judge) of the Department of Arbitration Practice. From March 2003 to 2017, he worked as the Deputy Chairman of the Judicial Chamber for cases related to the protection of intellectual property rights in the Supreme Arbitration Court of Ukraine (later — the Supreme Economic Court of Ukraine);


From 2017 to present time, he works as a judge of the Commercial Cassation Court within the Supreme Court

Since December 2004, Volodymyr Selivanenko is the Honored Lawyer of Ukraine.

 

According to the declaration, the judge's son, Selivanenko Volodymyr Volodymyrovych, worked as a chief consultant at the Supreme Economic Court of Ukraine from 2014 to 2016.

Associated with Kolomoisky

Volodymyr Selivanenko made decisions in favor of companies associated with Ihor Kolomoisky in the following cases:

1) On May 8, 2019, the Supreme Court with the panel of judges of the Commercial Cassation Court: Selivanenko V.P. (chairman), Bulgakova I.V. and Pilkova K.M., with the participation of Assistant Judge Lazareva O.S. (on behalf of the presiding judge), case № 910/9971/17 was considered. The decision on the case decided not to satisfy the complaint of the Antimonopoly Committee of Ukraine against the decision of the courts on the fine of oil companies of Ihor Kolomoisky "Ukrtatnafta" and "NPK Halychyna". The total amount of conspiracy at oil auctions is estimated at a total of 1.3 billion hryvnias (Korrespondent.net).


2) On August 19, 2019, in the case № 916/1058/18 the Supreme Court with the panel of judges of the Commercial Cassation Court: Selivanenko V.P. (chairman), Bulgakova I.V. and Pilkova K.M. The materials of the cassation appeal of Hadzhybei LLC  and the statement of the NBU on the abuse of Hadzhybei LLC procedural rights to the decision of the South-West Commercial Court of Appeal from 28.02.2019 on the claim of the NBU of Ukraine toHadzhybei LLC for foreclosure on the mortgage, which does not declare independent claims on the subject matter of the dispute, on the side of the defendant — the public joint-stock company Commercial Bank "Privatbank".

The court decided to refuse to open cassation proceedings on the cassation appeal of Hadzhybei LLC against the decision of the South-West Commercial Court of Appeal in the case № 916/1058/18 (28.02.2019).

The NBU's application for recognition of actions as an abuse of procedural rights, leaving the cassation appeal without consideration and imposing a fine should be rejected (Ligazakon).
